On 20 January 2026, exercising her constitutional powers, the First President of the Supreme Court, dr hab. Małgorzata Manowska, submitted a motion to the Constitutional Tribunal to examine the constitutionality of such an interpretation of the provisions of the Act of 8 December 2017 – the Supreme Court Act, the Act of 27 July 2001 – Common Courts Act, and the Act of 25 July 2002 – Administrative Courts Act, which stipulates that official acts of the President of the Republic of Poland concerning appointments to judicial positions require the signature (countersignature) of the Prime Minister to be valid.
